“I have done hundreds, if not thousands, of initial consultations and second opinion consults in my 17-year career as an injury attorney. With those thousands of consults, I have learned that we have two simple goals for 100% of our clients. Achieving the two goals is not always possible but understanding what the two goals are and, more importantly, informing your client of them is critical in having a successful PI firm.
Goal #1: Ensuring that your client achieves full medical improvement.
Goal #2: Ensuring that your client obtains full monetary compensation.
As stated above, achieving both goals is not always achievable as a defendant’s policy limits and ability to personally contribute is a huge factor in a plaintiff’s ability to obtain compensation to pay for the resulting medical bills, lost earnings, and pain and suffering. For example, California has the lowest required liability policy limits for automobile insurance in the United States despite having the most cars on the road in any state (i.e., $15,000 per person). This results in cases where clients with catastrophic injuries cannot be fully treated nor will they be fully compensated as the at-fault defendant simply does not possess enough insurance to achieve both goals and is probably “judgment proof.”
In the end, understanding your two goals and informing your client of the law and how it applies to their case will result in a client that may not be happy if they are underinsured, but a client that will return to you and refer friends/family.”
